Seems like the appetite for an increase in County Court Guideline Hourly Rates is gaining momentum. In the Court of Appeal case of Cohen v Fine & Ors, His Honour Judge Hodge QC, has allowed a 35% enhancement to GHR to allow for inflation as a starting point. The decision echoes the findings of the Court of Protection and the case of Ohpen. This decision now reaffirms the position already taken by Deep Blue Costs and by many others that the starting point should be the 2010 guideline rates plus inflation enhancement before considering other factors specific to the case for further enhancement. The Civil Justice Council's review of GHR is underway and it is yet to be seen what level or if any adjustments will be made to the GHR which have been stagnant since 2010.
